Deportation Defense Attorney in Dallas, TX
A Notice to Appear or an ICE detention starts a court case with real defenses. I represent people in removal proceedings from the first hearing to the final decision.
As your removal defense attorney, I handle immigration court cases at the Dallas immigration court and, because immigration courts are federal, nationwide: bond hearings for detained family members, asylum and cancellation of removal, motions to reopen, and appeals. The fee is flat, quoted in writing after a free 20-minute consultation, in English or Spanish.
Where You Are Now
When to call a deportation lawyer
You received a Notice to Appear
The NTA starts the court case. We test the charges, confirm your hearing date and address with the court, and map every defense before the first hearing.
How removal proceedings workA family member is detained by ICE
Two tracks run at once: release and the removal case. We check bond eligibility, prepare the bond hearing, and start the defense while the detained docket moves fast.
Immigration bond hearingsA hearing is coming up, or one was missed
Relief applications have court deadlines. If a hearing was missed and an order issued in your absence, a motion to reopen may still be available.
Motions to reopenThe judge ordered removal
An appeal to the Board of Immigration Appeals is generally due within 30 days, and the order is not final while a timely appeal is pending.

The defenses we build
Removal defense is mostly a matching exercise: which forms of relief your facts support, and which is strongest. Many people qualify for more than one, with very different evidence demands and risks, so the order matters as much as the choice.
- Asylum, withholding of removal, and CAT protection: for a well-founded fear of persecution or torture in the home country, raised as a defense in court.
- Cancellation of removal (EOIR-42B): for people without a green card with ten years of continuous presence, good moral character, and exceptional hardship to a U.S. citizen or resident spouse, parent, or child.
- Cancellation for green card holders (EOIR-42A): for permanent residents facing removal, based on length of residence and the nature of any criminal history.
- Adjustment of status in court: a green card through a family petition, where the entry history allows it, decided by the judge.
- VAWA, U visa, and T visa: humanitarian protection for survivors of abuse, crime, or trafficking.
- Waivers: for grounds of inadmissibility that would otherwise block relief.
- Voluntary departure: leaving without a removal order, which keeps better options open for the future.
Detention and Bond
If ICE has detained someone you love
When someone is taken into immigration custody, the first question is whether they can be released on bond while the case goes on. For people who are eligible, an immigration judge can review the custody decision at a bond hearing, where the judge weighs flight risk and danger and sets the amount. We prepare that hearing with the family: proof of address, work, family ties, and community support.
In Texas, the Fifth Circuit currently treats people who entered without inspection as subject to mandatory detention, so for them the route to a custody hearing usually runs through a federal habeas petition instead. Our firm does not file habeas petitions; we will tell you when that is the right route and refer you. Our guides on immigration bond lawyers and bond hearings explain both tracks.

Common Questions
Deportation Defense FAQs
What does a deportation defense attorney do?
A deportation defense attorney represents you in removal proceedings before the immigration court. That means testing the charges on the Notice to Appear, screening your history for every form of relief you may qualify for, building the evidence, filing the applications by the court’s deadlines, and presenting your case at each hearing, including the final merits hearing.
What should I do first if I receive a Notice to Appear?
Keep the document safe, note any hearing date on it, make sure the court has your correct address, and have a lawyer review the charges before your first hearing. The Notice to Appear defines what the government must prove and which defenses fit, so an early review shapes everything that follows.
Does everyone in removal proceedings get deported?
No. Removal proceedings are a court process, not a foregone conclusion. Many people qualify for at least one form of relief, such as asylum, cancellation of removal, adjustment of status, a humanitarian protection, or voluntary departure. No lawyer can promise a result, but the options are usually wider than people expect.
My relative was just detained by ICE. What do we do?
Locate them in the ICE detainee locator, gather their identity and immigration documents, and contact a lawyer promptly. Detained cases move quickly. Depending on their history, a bond hearing before an immigration judge may be available; for people who entered without inspection, Texas courts currently treat detention as mandatory, and the route is usually a federal habeas petition, which we do not file but will tell you about.
What is cancellation of removal?
A defense available only in immigration court. For people without a green card it generally requires ten years of continuous presence, good moral character, and exceptional and extremely unusual hardship to a U.S. citizen or permanent-resident spouse, parent, or child. It is requested on Form EOIR-42B. A separate version, on Form EOIR-42A, exists for green card holders.
What happens if I miss an immigration court hearing?
The judge can order you removed in your absence. If you missed it because you never received proper notice, or because of exceptional circumstances, a motion to reopen may be available, but these motions have their own requirements and deadlines, so act quickly.
Can I appeal if the immigration judge orders removal?
Yes. An immigration judge’s decision can generally be appealed to the Board of Immigration Appeals within 30 days, and the order is not final while a timely appeal is pending. The deadline is strict, so the decision to appeal needs to be made right after the ruling.
How much does a deportation lawyer cost?
It depends on the relief being pursued and whether the case is detained. We quote a flat fee for the defined scope of the defense after a free 20-minute consultation, so you know the full attorney cost before you commit. Government filing fees for relief applications are separate.
