You must have information about the crime and have been, are being, or are likely to be helpful to law enforcement.

Law Enforcement Certification

A certifying official must sign Form I-918 Supplement B confirming your helpfulness.

Crime Occurred in the U.S.

The crime must have occurred in the United States or violated U.S. law.

U Visa FAQs

How long does the U Visa process take?

Due to the annual cap of 10,000 U Visas, current wait times exceed 5+ years. However, you may receive a Bona Fide Determination (BFD) that provides work authorization and deferred action while waiting.

What is a Bona Fide Determination?

A BFD is granted to applicants who appear to be eligible for a U Visa while they wait for a visa number. It provides work authorization and protection from removal.

Can my family members be included?

Yes, U Visa holders can petition for qualifying family members including spouse, children, parents (if you are under 21), and siblings (if you are under 21).

What if I have a criminal record?

Having a criminal record does not automatically disqualify you. The U Visa has generous waiver provisions, and we can evaluate your specific situation.
